General Conditions of Use

ARTICLE 1 : purpose

These “terms and conditions of use” are intended to legally regulate the use of the Speakee website and its services.
The terms and conditions of use apply between: The manager of the website, hereinafter referred to as “the Publisher”, Any natural or legal person wishing to access the site and its services, hereinafter referred to as “the User”.
The terms and conditions of use must be accepted by all Users, and accessing the site constitutes acceptance of these conditions.

ARTICLE 3 : Access to the Services

 

If the User is a member of the Speakee website (meaning they are identified using their login credentials), they have access to the following services:

  • Online courses with a teacher.
  • E-learning courses.
  • E-books.
  • PDF, audio, and video files.

Any User with internet access can access the site for free from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not the responsibility of the Publisher. The site and its various services may be interrupted or suspended by the Publisher, particularly for maintenance purposes, without prior notice or justification.

ARTICLE 4 : user responsibility

 

The User is responsible for the risks associated with the use of their login credentials and password. The User’s password must remain confidential. In case of password disclosure, the Publisher disclaims any responsibility. The User assumes full responsibility for the use they make of the information and content present on the Speakee website. Any use of the service by the User that directly or indirectly results in damage must be compensated in favor of the Speakee website. The site does not allow members to publish information on the Speakee website. If this condition were to change, the member would undertake to express themselves respectfully towards others and the law and would accept that these publications be moderated or refused by the Publisher, without obligation of justification. By publishing on the site, the User would grant the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast, and distribute their publication, directly or through an authorized third party.

ARTICLE 5 : Publisher’s Liability

 

Any malfunction of the server or network cannot be the responsibility of the Publisher.
Likewise, the site’s responsibility cannot be engaged in the event of force majeure or the unforeseeable and insurmountable actions of a third party.
Speakee’s website undertakes to implement all necessary measures to ensure the security and confidentiality of data. However, it does not provide a total security guarantee given current technologies.
The Publisher reserves the right to disclaim reliability of sources, although the information disseminated on the site is deemed reliable.

ARTICLE 6 : Intellectual Property

 

The content of the Speakee website (logos, texts, graphic elements, videos, etc.) is protected by copyright under the Intellectual Property Code. The User must obtain permission from the site’s publisher before reproducing, copying, or publishing any of this content. Any private and/or commercial use is prohibited. The User is solely responsible for any content they upload and agrees not to infringe upon any third party rights.

The User must provide personal information to proceed with their registration on the site. The user’s email address may be used by Speakee for various communications and account management purposes. Speakee guarantees the user’s privacy in accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms. Under Articles 39 and 40 of the law dated January 6, 1978, the User has the right to access, rectify, and oppose their personal data. The User exercises this right via:

  1. Their personal space on the site (when the User is a member of the site);

ARTICLE 8 : HYPERTEXT LINKS

 

The domains to which the hypertext links on the Speakee website lead do not engage the responsibility of the Speakee Editor, who has no control over these links.
It is possible for a third party to create a link to a page on the Speakee site without the express permission of the editor, particularly for the purpose of promoting Speakee’s activities.

ARTICLE 9 : Evolution of the Terms of Use

 

The Speakee website has the right to modify the clauses of these terms of use at any time and without justification.

ARTICLE 10 : DURation

 

The duration of these terms and conditions of use is indefinite. This agreement takes effect for the User from the beginning of the use of the service.

ARTICLE 11 : APPLICABLE LAW AND JURISDICTION

This contract is governed by French law. In the event of a dispute not resolved amicably between the User and the Publisher, the courts of Nice (France) have jurisdiction to settle the dispute.
